These Terms of Service (“Terms”) govern your use of lpskinshop.com and purchases from L&P Aesthetics Medical, Inc., doing business as L&P Skin Shop (“L&P Skin Shop,” “we,” “us,” or “our”). By accessing the site or placing an order, you agree to these Terms. If you do not agree, do not use the site.

Eligibility and accounts

You must be at least the age of majority where you live and able to enter into a binding agreement. You are responsible for accurate account information, safeguarding login credentials, and all activity under your account. Notify us promptly of suspected unauthorized use.

Products and health information

We sell professional skincare products for personal use. Product descriptions, ingredient lists, images, availability, and pricing may change, and packaging may differ from images. We try to be accurate but do not warrant that all site content is complete, current, or error-free. Manufacturer instructions and packaging control if site information differs.

Store content and product recommendations are educational and are not medical advice, diagnosis, or treatment. Products are not a substitute for care from a qualified professional. Review ingredients and directions, patch test when appropriate, discontinue use if irritation occurs, and consult a clinician if you are pregnant, nursing, have a medical condition, take medication, or have questions about suitability. Emergency concerns require immediate medical care.

Orders and acceptance

Your order is an offer to purchase. We may accept, decline, limit, or cancel an order, including for suspected fraud, inventory or pricing errors, product restrictions, or unauthorized resale. An order confirmation acknowledges receipt and does not guarantee acceptance or shipment. If we cancel after payment, we will refund the canceled amount to the original payment method.

You agree to provide current billing, shipping, and contact information. Products are for personal use and not for unauthorized resale or export. Quantity limits may apply.

Prices, payment, and promotions

Prices are shown in U.S. dollars unless stated otherwise and may change without notice. Taxes and shipping are calculated as applicable. You authorize us and our payment providers to charge the selected payment method for the total shown at checkout. Promotions may have additional terms, availability limits, exclusions, and expiration dates. Unless stated otherwise, promotions cannot be combined or applied retroactively.

Shipping, pickup, and returns

Our Shipping Policy and Refund Policy are incorporated into these Terms. Delivery dates are estimates and may be affected by carriers, weather, address errors, or events outside our control. Title and risk of loss transfer as provided by applicable law.

Privacy and medical records

Our Privacy Policy explains our ecommerce data practices. Protected health information handled in connection with clinical care is addressed separately in our HIPAA Privacy Notice. Do not submit medical records through general store forms or ordinary email.

Acceptable use

You may not misuse the site; violate law or another person’s rights; submit false, fraudulent, harmful, or malicious content; interfere with site security or operation; scrape or access the site by unauthorized automated means; transmit malware; attempt unauthorized access; or use products or content for unlawful resale, counterfeit activity, or deceptive claims.

Intellectual property

The site and its text, graphics, logos, photographs, design, and other content are owned by or licensed to us and protected by intellectual-property laws. We grant you a limited, revocable, nonexclusive right to use the site for personal, noncommercial shopping. No other rights are granted. Product and company names may be trademarks of their respective owners.

Third-party services and links

The site may use or link to services operated by third parties. We do not control and are not responsible for third-party content, terms, privacy practices, availability, or performance. Your use of third-party services is subject to their terms.

Disclaimer of warranties

To the fullest extent permitted by law, the site and its content are provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, and noninfringement, except that these disclaimers do not limit warranties or rights that cannot lawfully be excluded. Product warranties, if any, are provided by the manufacturer.

Limitation of liability

To the fullest extent permitted by law, L&P Skin Shop and its affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, data, or goodwill, arising from the site or products. Our aggregate liability for a claim will not exceed the amount you paid us for the product or order giving rise to the claim. These limitations do not apply where prohibited by law.

Indemnification

To the extent permitted by law, you agree to indemnify and hold us harmless from third-party claims arising from your unlawful misuse of the site, violation of these Terms, or infringement of another person’s rights.

Changes, suspension, and termination

We may update these Terms by posting a revised version and changing the date above. Changes apply prospectively unless law requires otherwise. We may suspend or terminate access for conduct that violates these Terms or threatens the site, customers, or others.

Governing law and severability

These Terms are governed by the laws of California, without regard to conflict-of-law rules, except where consumer law requires otherwise. If a provision is unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver.
